Asks whether to eliminate the office of register of probate by amending Part II, Articles 71 and 81 of the state constitution. Article 71 would keep county treasurers, county attorneys, sheriffs and registers of deeds as elected county officers; Article 81 would keep the bar on judges acting as counsel in probate business. The amendment passed the House 325 to 15 and the Senate 23 to 1, per the Secretary of State's notice of questions on the 2026 general election ballot.

About these measures
New Hampshire constitutional amendments require two-thirds voter approval to pass. The Secretary of State's 2026 general election ballot notice lists one statewide question (CACR 13). A second question on that notice, a two-year school district property tax growth limit under RSA 32:5-i (HB 1300, Chapter 324, 2026), appears only in the municipalities that placed it on their local ballot and needs a three-fifths vote there; it is not a statewide measure.
